Is a probation confirmation letter legally required in India?

There's no single central law that names a "probation confirmation letter" as mandatory by that title. But most certified standing orders and company probation clauses require the employer to notify the employee in writing when probation ends — either confirming or extending it — because the notice period, and sometimes the compensation, change from that date. Treat it as required by your own policy and appointment letter terms, not a decorative formality.

If no letter is sent, is the employee automatically confirmed once probation ends?

It depends entirely on what your original appointment letter's probation clause says, not on a blanket statutory default. Some appointment letters state that employment is deemed confirmed automatically if no action is taken by the end of probation; others require explicit written confirmation before the longer post-confirmation notice period takes effect. Check that clause before assuming either way.

What's the difference between a confirmation letter and an appointment letter?

The appointment letter is issued at joining and sets the initial terms, including the probation period and its shorter notice period. The confirmation letter is issued once probation is successfully completed — it formally moves the employee to permanent status, switches the notice period to the longer post-confirmation figure, and states any compensation revision, while everything else in the original appointment letter continues to apply.

Can probation be extended instead of confirmed?

Yes. If performance hasn't met the bar by the probation end date, most Indian companies issue a separate probation extension letter for one further review period rather than a confirmation letter. This tool drafts the confirmation letter only — an extension needs its own document with a new review date, which this generator doesn't cover.

Does confirmation reset the gratuity eligibility clock?

No. Gratuity eligibility is counted from the original date of joining, not the confirmation date — 5 years of continuous service under the Payment of Gratuity Act, or 1 year for fixed-term employees who joined on or after 21 November 2025 under the Labour Codes.
